Penalties

Violations of the Export Control regulations are severe and may be imposed against the individual as well as the University. Such penalties include significant monetary fines and lengthy prison sentences. FAU personnel may not transfer any technology or technical data contrary to U.S. Export Control laws or FAU's rules, regulations, policies, or procedures.

Violations under the International Trafficking in Arms Regulations (ITAR) may bring criminal penalties of up to $1,000,000 per violation as well as up to ten (10) years imprisonment. Violations under the ITAR may also include civil penalties of $1,094,910 per violation.

Violations under the Export Administration Regulations (EAR) may bring criminal penalties of up to $1,000,000 per violation against an entity or five (5) times the value of the export(s), whichever is greater. Violations by an individual may bring criminal penalties of up to $250,000 and/or ten (10) years imprisonment. Violations under the EAR may also include civil penalties against an entity in the amount of $50,000 or five (5) times the value of the export(s), whichever is greater. Violations by an individual may bring civil penalties of up to $50,000 per violation and up to five (5) years imprisonment.

Violators may also be subject to denial of their export privileges. A denial of export privileges prohibits a person from participating in any way in any transaction subject to the EAR. Furthermore, it is unlawful for other businesses and individuals to participate in any way in an export transaction subject to the EAR with a denied person.
